These Terms of Service (“Terms”) govern your access to and use of Captures Studio, a product operated by NHU AI (“NHU AI”, “we”, “us”, or “our”), available at https://captures.studio (the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About NHU AI & Captures Studio

NHU AI is the legal entity that owns and operates Captures Studio.

Captures Studio provides tools and services for creating, managing, and delivering immersive and interactive digital capture and reconstruction experiences. Certain features of the Service require payment through one-time unit purchases and/or subscription plans.

2. Eligibility

You must be at least 18 years old or have legal parental or guardian consent to use the Service. By using the Service, you represent that you meet this requirement.

3. Account Registration

To access paid features, you must create an account. You agree to:

Provide accurate and complete information
Maintain the security of your account credentials
Be responsible for all activities under your account

NHU AI is not responsible for unauthorized access resulting from your failure to safeguard credentials.

4. Pricing Models

Captures Studio offers two pricing models:

4.1 One-Time Unit Purchases (Top-Ups)

Users may purchase usage units (“Units”) via one-time payments
Units do not auto-renew
Units are consumed for eligible features (including reconstructions)

4.2 Subscription Plans

Subscription plans are billed on a recurring basis (monthly or annually, as displayed)
Subscriptions may include a recurring allocation of Units or credits
Subscription credits reset each billing cycle unless otherwise stated
Unused subscription credits do not roll over, unless explicitly specified

All pricing details are shown clearly before checkout.

5. Payments & Billing

5.1 Payment Processing

All payments are processed securely through third-party payment processors (such as Stripe). NHU AI does not store full payment card information.

By purchasing a top-up or subscription, you authorize NHU AI to charge the applicable fees.

5.2 Auto-Renewal (Subscriptions Only)

Subscriptions automatically renew at the end of each billing period unless canceled before renewal.

You may cancel your subscription at any time through your account dashboard. Cancellation becomes effective at the end of the current billing cycle.

6. Refund Policy (No Refunds)

All purchases are final and non-refundable.

This applies to:

One-time Unit purchases (top-ups)
Subscription fees
Included or unused credits
Partially used billing periods

NHU AI does not provide refunds for:

Unused Units or credits
Mid-cycle subscription cancellations
Accidental purchases
Change of mind
Account inactivity or lack of usage

Mandatory consumer protection rights may apply where required by law.

7. Usage of Units & Credits

Units and credits grant access to specific features within Captures Studio
They have no cash value
They are non-transferable
They cannot be resold or exchanged

NHU AI reserves the right to adjust how Units or credits are consumed, provided such changes do not materially reduce already purchased value.

Abuse or manipulation of the credit system may result in suspension or termination.

8. Acceptable Use

You agree not to:

Use the Service for unlawful purposes
Upload malicious, harmful, or infringing content
Attempt to reverse engineer or exploit the platform
Interfere with security or system performance

Violations may result in suspension or termination without refund.

9. Intellectual Property

All software, designs, trademarks, content, and technology associated with Captures Studio are the exclusive property of NHU AI or its licensors.

You are granted a limited, non-exclusive, non-transferable license to use the Service as intended.

10. Service Availability & Changes

NHU AI may:

Modify, suspend, or discontinue features
Change pricing for future purchases
Update subscription plans or included credits

Changes will not affect already purchased Units or the current subscription billing period.

11. Termination

You may stop using the Service at any time.

NHU AI may suspend or terminate your account if:

You violate these Terms
You misuse the Service
Required by law or security considerations

Unused Units or credits are forfeited upon termination and are not refundable.

12. Disclaimer of Warranties

The Service is provided “as is” and “as available.”
NHU AI disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the maximum extent permitted by law, NHU AI shall not be liable for indirect, incidental, or consequential damages.

NHU AI’s total liability shall not exceed the amount paid by you in the 30 days preceding the claim.

14. Privacy

Your use of the Service is governed by our Privacy Policy, which explains how NHU AI collects, uses, and protects personal data.

15. Governing Law

These Terms are governed by the laws of the jurisdiction in which NHU AI is legally registered, without regard to conflict of law principles.

16. Changes to These Terms

NHU AI may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms.
